Advertisements
EVERYDAY MEDICAL will advertise products and/or services online on behalf of third parties on your personalized web platform and provide you with the opportunity to opt-in (and opt-out) for e-mails from EVERYDAY MEDICAL targeted to your needs, but no personally identifiable information will be shared with these advertisers, sponsors, or any other third party that is not an affiliate of EVERYDAY MEDICAL.

Data Aggregation
EVERYDAY MEDICAL will combine demographic and other information about our users obtained from registration forms and user profiles, creating "aggregate data." All personally identifiable information will be removed from this data before disclosing such data to third parties. Aggregate data disclosed to third parties does not contain any information that could be used to identify or contact our users.

Please note that EVERYDAY MEDICAL currently contracts with a third party to help manage and optimize our Internet business and communications. This web site usage tracking company helps us measure how visitors use our site and the effectiveness of our advertising by using Web beacons and cookies. The type of data we collect includes but is not limited to the pages visited and links clicked on by users. Although this third party company logs the information coming from our site on our behalf, we control how that data may and may not be used.

What type of information does the Privacy Policy cover?

As used in this Privacy Policy, "EVERYDAY MEDICAL" includes all of its subsidiary and affiliated corporate entities and companies. This policy does not apply to the practices of companies that EVERYDAY MEDICAL does not own or control or to people that EVERYDAY MEDICAL does not employ or manage.

Unless otherwise stated, this Privacy Policy applies only to personally identifiable information collected on the EVERYDAY MEDICAL Web sites and/or through the EVERYDAY MEDICAL e-mail system. It does not apply to any other information collected by EVERYDAY MEDICAL by any other means.

Information You Provide to Us

Much of the personally identifiable information we receive comes directly from users who are interested in obtaining information, products and/or services from us or who sign up for such services or purchase products. We collect personal information when you register on, complete a profile on or contact us through our Web sites or when you e-mail us. We may also collect other types of information (non-identifiable information), such as gender, age, personal interests and medical or health-related information that we may associate with personally identifiable information.

Information Collected Through Technology

We also collect information through technology to make our sites more useful to you and to track user Web activity and interests. Our Web sites use "cookies," which are pieces of information a Web site sends to your computer while you are viewing the Web site, for a variety of purposes. For example, when you return to one of our sites after logging in, cookies provide information to the site so that the site will remember who you are. We also use information collected through Web beacons, which are small pieces of data that are embedded in images on the pages of Web sites, to analyze the traffic patterns on our Web sites, such as the frequency with which our users visit various parts or pages of our Web sites. We may manage and place advertisements on our Web sites on behalf of third parties referred to herein as "network advertisers." We may also use cookies and other technology to collect information when you click on or move your cursor over one of these banner advertisements. EVERYDAY MEDICAL currently contracts with a third party to help manage and optimize their Internet business and communications. These Web site tracking companies helps them measure the effectiveness of our advertising and how visitors use their sites through use of Web beacons and cookies provided by this company. The type of information they collect includes, but is not limited to, the pages visited and links clicked by users. By supplementing our records, this information helps us learn things such as what pages are most useful and attractive to our visitors; which of our products, tools and information most interest our customers; and what kinds of offers our customers like to see. Although the third party company logs the information coming from our site on our behalf, we control how that data may and may not be used.

From time to time, we may purchase a business or sell one or more of our businesses and personally identifiable information may be transferred as a part of the purchase or sale. In the event that we sell a business, we will include provisions in the selling contract requiring the purchaser to treat your personally identifiable information in the same manner required by this Privacy Policy (including any amendments to this Privacy Policy). EVERYDAY MEDICAL will disclose personal information when they believe in good faith that such disclosures (a) are required by law, such as to comply with a court order or subpoena, or (b) will help to enforce our Terms of Use; protect your safety or security, including the safety and security of property that belongs to you; and/or protect the safety and security of our Web sites, EVERYDAY MEDICAL and/or third parties, including the safety and security of property that belongs to EVERYDAY MEDICAL or third parties.

Our systems require time to update, and promotional mailings, by e-mail or otherwise, using personal information shared before your opt-out may already be in process. What kinds of security measures do we take to safeguard your personally identifiable information?

The security and confidentiality of your information is of utmost importance to us. HOW WE MAY USE AND DISCLOSE YOUR PROTECTED HEALTH INFORMATION

We may use and disclose your protected health information for different purposes. The examples below are provided to illustrate the types of uses and disclosures we may make without your authorization for payment, home care operations, and treatment.

• Payment. We use and disclose your protected health information in order bill and collect payment for the services and items you may receive from us. For example, we may contact your health insurer to certify that you are eligible for benefits and we may provide your insurer with details regarding your treatment to determine if your insurer will cover, or pay for, your equipment. We also may use and disclose your health information to obtain payment from third parties that may be responsible for such costs, such as family members. Also, we may use your health information to bill you directly for services and items.
• Home Care Operations. We use and disclose your protected health information in order to perform our home care activities, such as providing equipment appropriate to your needs, or administrative activities, including data management or quality assessment activities.
• Treatment. We may use and disclose your protected health information to coordinate services with other health care providers involved in your care. For example, we may collect measurements to identify appropriate seating and mobility system(s). We may obtain and disclose information on CPT diagnosis codes, diagnosis and prognosis, functional limitations, pre-existing health conditions, hospitalizations, prior use of equipment, and information specific to qualifying the patient as dictated by CMN / detailed written order forms.
• Appointment Reminders. We may use and disclose your health information to contact you and remind you of visits / deliveries.
• Health-related Benefits and Services. We may use and disclose your health information to inform you of health-related benefits or services that may be of interest to you.
• Release of information to Family / Friends. We may release your health information to a friend or family member that is helping you to pay for your health care, or who assists in taking care of you.
• Disclosures Required by Law. We will use and disclose your health information when we are required to do so by federal, state or local law.

OTHER PERMITTED OR REQUIRED DISCLOSURES

• As Required by Law. We must disclose protected health information about you when required to do so by law.
• Public Health Activities. We may disclose protected health information to public health agencies for reasons such as preventing or controlling disease, injury, or disability.
• Victims of Abuse, Neglect, or Domestic Violence. We may disclose protected health information to government agencies about abuse, neglect, or domestic violence.
• Health Oversight Activities. We may disclose protected health information to government oversight agencies. Oversight activities can include, for example, investigations, inspections, audits, surveys, licensure and disciplinary actions; civil, administrative, and criminal procedures or actions; or other activities necessary for the government to monitor government programs, compliance with civil rights laws and the health care system in general.

If you revoke your authorization, we will no longer use or disclose medical information about you for the reasons covered by your written authorization. YOUR RIGHTS REGARDING YOUR PROTECTED HEALTH INFORMATION

You have certain rights regarding the protected health information that the we maintain about you.

• Right To Access Your Protected Health Information. You have the right to review or obtain copies of your protected health information records, with some limited exceptions. Usually the records include referral information, delivery forms, billing, claims payment, and medical management records. Your request to review and/or obtain a copy of your protected health information records must be made in writing to EveryDay Medical, 139 Fulton St., Suite 814, New York, NY 10038, Attn: Privacy Officer. We may charge a fee for the costs of producing, copying, and mailing your requested information, but we will tell you the cost in advance.
• Right To Amend Your Protected Health Information. If you feel that protected health information maintained by us is incorrect or incomplete, you may request that we amend the information. Your request must be made in writing to EveryDay Medical, 139 Fulton St., Suite 814, New York, NY 10038, Attn: Privacy Officer and must include the reason you are seeking a change. We may deny your request if, for example, you ask us to amend information that was not created by us, or you ask to amend a record that is already accurate and complete. If we deny your request to amend, we will notify you in writing. You then have the right to submit to us a written statement of disagreement with our decision and we have the right to rebut that statement.
• Right to an Accounting of Disclosures. You have the right to request an accounting of the disclosures we have made of your protected health information. The list will not include our disclosures related to your treatment, our payment or health care operations, or disclosures made to you or with your authorization. The list may also exclude certain other disclosures, such as for national security purposes. • Right To Request Restrictions on the Use and Disclosure of Your Protected Health Information. You have the right to request that we restrict or limit how we use or disclose your protected health information for services, payment, or health care operations. At our discretion, we may choose not agree to your request. If we do agree, we will comply with your request unless the information is needed in an emergency.
